Hello all, I have a favor to ask. I was at the Springfield Walmart this past Saturday, 6/2/07, around 12:45 picking up a RX. I had just paid and was waiting for an consult when this guy about 6’2” walks in front of me, so I say nothing and the guy starts yelling at the pharmacist. This goes on at least 10 mins. He is yelling, cursing and insisting they fire the girl next to the pharmacist even though the pharmacist has repeatedly told the guy she wasn’t involved, apparantly someone there had messed up his RX??? Well, no one is saying anything and he is getting what he wants but now he starts cursing at the people in line, and I’m right next to the moron. I tell the guy, look, no one is bothering you, your getting what you want, how about tnot cursing at us? He gets about 3 inches from my face and screams, no idea what he said but it was very loud. I yelled at him to shut up and back off and he lunged at me like he attacking me. Again this guy is at least 6’2” and unlike the pharmacy staff I don’t have a wall between me and him. There is no where for me to go, he blocks the way in front, there is a small crowd behind me because he has been there so long things are back up, the pharmacy counter is to my right and an end display is to my left. I had started my defense atttack before I had even realized it. The best I could manage was to open my fist to a palm strike and not follow through. I hit him with a palm strike to the left carotid artery, at about 30-40% strength. He stopped, backed off and started whinning, “She hit me! It hurt! I’m calling the cops!” As I mentioned before this man had been at the counter a good 10 minutes and was cursing and very aggressive the whole time and Walmart staff did nothing until I hit him. I was the criminal. The manager, Ken, had me in ther front of the store for a good 15-20 mins, surrounded by 5-6 large guys until the police arrived. The manager, Ken talked to the guy that assulted me and he was allowed to stand on his own to the side and continue his temper tantrum, the manager would not even talk to me. The Sgt. took statements and that was that. I called the Walmart manager Ken, Sunday afternoon explaining who I was and that I was looking for witnesses to what had happened, he would not give me any info but told me that there was a security video he would not release to me but he MIGHT give it to the police. So Iasked and the Sgt. picked the tape up Monday. It must have verified my story because the Sgt. and the city prosecutor refused to bring charges against me. On Monday I left a message for Ken as I had been hurt pulling the punch on the moron and I was asking Walmart to pay the medical expenses. He did not return my call. On Tuesday afternoon I called and spoke with the manager, Ken, explaining who I was and that I was seeking medical care st their expense. He was very rude and I quote, “There wouldn’t have been any probelm if you hadn’t hit him, would there now?!” I refused to argue with him and told him legal personnel would be in touch, he yelled “Fine!”.
I did get ahold of corporate Walmart yesterday and they took a very different attitude and filed for two seperate claims against the store and told me to get medical care. At this point the feel I strained my muscles and tendons in my shoulder, elbow and back hyperextending my arm while pulling back from hitting the guy.If its not better in a couple of weeks I may have torn something.
The day after going to the ER. Walmart corporation called and changed their minds. They backed their manager 100% and refused to have anything to do with the ER bill their rep had sent me to.
If you disagree with the way this was handled please call 1-800-925-6278, press 1 on the fisrt option, then 4, then 3 and another 3 will get you to a real person to lodge a complaint. You can also go to http://www.walmart.com/cservice/cu_co… There will be an email option and can register a complaint that way.
