Attorney General Andrew M. Cuomo moved today to sue ExxonMobil and four other companies over millions of gallons of oil lying under the Greenpoint neighborhood in Brooklyn and to repair environmental damage inflicted on the nearby Newtown Creek.

Because the article applies to ExxonMobil, not the Attorney General and thus it reflects poorly on ExxonMobil.

It should provide examples that urge writers to not be ambiguous as to what is being rated. In this case, it’s exxon, but it can also be construed as Cuomo.

A better wording would be “Exxon Polluting in Brooklyn.” And then, “according to fmr. Mayor Cuomo, who is now suing Exxon, Exxon has blah blah.”

Why negative toward Exxon's social performance rating

There actually many stories on dotherightthing mentioning lawsuits against companies. I would argue that legal action, or mention of intent to pursue such is an event that is representative of an action more substantial than speculation. Therefore, while there might have been speculation of Exxon’s wrongdoing before, there is now legal action on its way with the intent to prove that Exxon is responsible for the pollution. I would expect another negatively-rated story if the lawsuit is successful in proving that Exxon is responsible, despite the fact their wrongdoing would be punished by the lawsuit’s verdict, because Exxon has therefore either been proven beyond reasonable doubt to have neglected to “do the right thing” in its activities, admitted guilt, and/or settled.
